Construction Dive’s “Minimizing risks and disputes in public contracting” event will aim to answer critical questions about how leaders and managers from the C-suite and beyond can create a risk management strategy around large infrastructure projects. Topics include ensuring budget adherence for the owner and profitability for the contractor, as well as avoiding as many disputes as possible. The event will take a detailed look at risks and provide solutions to navigate complex legal, technical and regulatory requirements while managing an array of stakeholders.

Session 1 Breaking down progressive delivery approaches This session will explore the relatively new approach of using progressive delivery methods on large infrastructure projects and how we got here. Historically, most governments’ hands were tied to simply pick the lowest bidder on a project, which could often lead to disputes. Now, “best value” contracts are increasingly common, allowing for more dialogue between different parties on a project. This panel will look at how delivery methods are evolving, and what it means for contractors who want to work on these projects today. Session 2 Dispute avoidance and de-escalation This session will examine the causes of disputes on complex civil megabuilds, including the submission of change orders that deviate from the original scope of the project due to unforeseen — and often unforeseeable — conditions. We’ll discuss contract formats and provisions that are flexible enough to allow for changes along the way while minimizing conflicts, including issues that range from supply chain snarls to inflation, unavoidable project delays and price escalations.
